Terms of Service
Last updated: [INSERT DATE]
Welcome to Calm Clinic. These Terms of Service ("Terms") govern your use of our website and telehealth services. By booking a consultation or using our website, you agree to these Terms.
1. About Our Service
Calm Clinic is an Australian telehealth platform that connects patients with AHPRA-registered doctors for consultations relating to medicinal cannabis treatment eligibility. We do not manufacture, sell, or directly supply medicinal cannabis products. Where a doctor determines treatment is appropriate, prescriptions are issued and fulfilled through independent, partner pharmacies.
2. Eligibility
Our services are intended for adults (18+) located in Australia. By using our service, you confirm that you meet this requirement and that the information you provide during booking and consultation is accurate and complete.
3. Nature of Consultations
- Consultations are conducted via telehealth (video or phone) by an AHPRA-registered doctor.
- A consultation does not guarantee a prescription. Treatment decisions are made solely at the clinical discretion of the consulting doctor, based on your individual circumstances.
- Our doctors operate independently in their clinical judgement. Calm Clinic does not direct or influence individual treatment decisions.
4. Fees and Payment
- Consultation fees are displayed at the time of booking and are payable in advance.
- Fees cover the consultation itself, regardless of outcome (i.e. a fee is payable whether or not a prescription is issued).
- [INSERT YOUR ACTUAL REFUND/CANCELLATION POLICY — e.g. cancellation notice period, late cancellation fees, no-show policy]
5. Prescriptions and Pharmacy Fulfilment
If a prescription is issued, it will be sent electronically to a partner pharmacy for dispensing. Pharmacy fees, shipping costs, and product availability are determined independently by the dispensing pharmacy and are not controlled by Calm Clinic.
6. Patient Responsibilities
You agree to:
- Provide accurate, complete, and truthful information during booking and consultation
- Attend your scheduled consultation on time, with a stable internet connection
- Use any prescribed treatment only as directed by your consulting doctor
7. Limitation of Liability
To the extent permitted by law, Calm Clinic is not liable for:
- Clinical decisions made by independent consulting doctors
- Delays, errors, or issues arising from third-party pharmacy fulfilment
- Technical issues outside our reasonable control that affect your ability to access a consultation
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
8. Privacy
Your use of our service is also governed by our [Privacy Policy], which explains how we collect, use, and protect your personal and health information.
9. Intellectual Property
All content on this website (text, graphics, logos) is owned by or licensed to Calm Clinic and may not be reproduced without permission.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
